Yellow Pages Group – Restructuring Update #1

On August 27, Yellow Pages implemented a restructuring within the Digital Fulfillment Department. Several existing positions were discontinued or significantly changed, with new classifications being created as part of the restructuring.

We were not provided advance notice of these changes, nor were we consulted, before they were implemented. Upon learning of the restructuring from affected members, we immediately contacted the Employer and raised concerns regarding both the requirements of our collective agreement and the Employer’s obligations under Section 54 of the BC Labour Relations Code.

Under Section 54 of the BC Labour Relations Code, where an employer is contemplating a significant change that may affect the terms, conditions or security of employment of a significant number of bargaining unit employees, it must provide the Union with at least 60 days’ advance notice before implementing the change. During that notice period, the Employer and Union are required to meet in good faith and make every reasonable effort to develop an adjustment plan aimed at minimizing the impact of the change on affected employees.

Since becoming aware of these changes, we have met with the Employer to address the restructuring and its impact on affected members.

We have tabled a proposed labour adjustment plan providing additional protections for affected employees while reserving all rights to address any matters in dispute through the grievance process or the BC Labour Relations Board.

Our current proposal includes options for affected employees who may not have been provided a clear transition pathway into a vacant position, protection against reductions in existing wage rates, preservation of seniority and service, and enhanced protections for members who elect layoff.

Discussions with the Employer are ongoing. We will provide members with a further update once the terms of the adjustment plan have been finalized or if the Parties are unable to reach mutual agreement and must seek intervention from the Board.
