Union Wins Inclusion Case at Labour Relations Board

Recently your union made written submissions and attended a hearing at the Labour Relations Board regarding our submission that a recently created position in the Safety Department, titled Safety Management System Analyst, was improperly excluded from the MoveUP bargaining unit.

We are pleased to announce that we have recently received the decision of Vice-Chair Leah Terai. In her decision, the Vice-Chair upholds the union’s submission and agrees that the Safety Management System Analyst is an employee for the purposes of the Labour Relations Code. A copy of the full decision is attached here for your reference.

Bargaining unit positions would generally be those jobs which do not perform the functions of a manager or superintendent (hiring, firing, issuing discipline), and are not employed in a confidential capacity in matters relating to labour relations or personnel. If you believe an excluded (non-union) position within your department ought to be included in the union please contact me to discuss.
