TransLink – Cyberattack and Credit Monitoring Update

It is hard to believe that it has already been two years since the cyberattack that potentially exposed private information of MoveUP members.  Some have been fortunate and their information has not been accessed while others have had to deal with the very real concern of their information being used for inappropriate purposes.

As everyone knows, TransLink offered credit monitoring for two years in order to assist employees with ensuring that their personal information was not being shared.  As signup was voluntary some MoveUP members took advantage of the opportunity and some chose not to.

MoveUP filed a grievance asking for a remedy that all employees, retirees, and spouses receive lifelong credit monitoring from Trans Union and Equifax.  As this is an evolving area of law we have left the grievance open as we have been hoping for some more definitive case law to develop that would establish further not only the right to have our member’s personal information properly protected but would also provide some indication that our suggested remedy is within the bounds of what is being awarded to workers who have been the victims of cyberattacks.

Bargaining for a renewed collective agreement will take place next year and not surprisingly cyberattacks and credit monitoring will be important issues at the table. It is very important that our members are not placed in harms way due to something completely beyond their control.

In the meantime, MoveUP is suggesting that any member who feels their information is vulnerable continues with the credit monitoring in place at their own cost.  We recently asked TransLink to continue to pay for credit monitoring while the issue was still unresolved and they were unwilling to do so.  We will try to recoup any money spent on the credit monitoring either through the grievance process or through bargaining.
