Teamsters Local 155 – Bargaining Update # 6 – BCLRB Conference Call

To: All MoveUP Members at Teamsters Local 155
Your Union scheduled and participated today in a conference call through the BC Labour Relations Board (BCLRB) with mediator Grant McArthur and your Employer. The purpose of this call was to review the matters that remain outstanding from the Section 11 application we filed with the BCLRB. The Section 11 application is an Unfair Labour Practice and our application was in regards to bad faith bargaining by the Employer.
Your Union’s intent was clear and concise, we wanted to avert the Section 11 hearing by clarifying the issues pertaining to the Employer’s Letter Of Understanding (LOU) proposal which was incorrectly presented to the Union in bargaining. This LOU had substantive concessional changes to an Article that had already been signed off by the parties.
Unfortunately, your Employer is not prepared to withdraw the LOU that they had proposed.Instead they proposed that they would agree to some minor changes in details, however, it was conditional on the Union agreeing to withdraw our Section 11 application at the BCLRB and then agreeing to revote their last offer package with the amendments.
Your Union was prepared to continue negotiations if we could resolve the issue regarding the LOU and have that issue held in abeyance. Our hope was that they would agree and we could then schedule mediation on the remaining outstanding matters.
It is very evident that the Employer will not move, leaving us no alternative but to pursue our Section 11 complaint. We were available to have that hearing as soon as is possible, but your Employer indicated they could not be available until May or June. Dates have been scheduled for June 1,2 and 5, 2020.
We are working hard to ensure we get the best deal for our members.
