RE: Tentative Split of Work in Burnaby and Grievance(s) Update

The Union has been made aware that TFI is currently negotiating with Fed-Ex and is anticipating splitting off the Fed-Ex work from other Canadian Freightways customers at the Burnaby location. We have been advised that they are looking to create a dedicated service model just for Fed-Ex.  They have assured us that they are not planning to split the company, however we will be monitoring the situation as at this point they have stated that they do not have plans to impact our clerical staff at that location.  However, they are not guaranteeing that the Fed-Ex work will remain in Burnaby.  Although we were told that this is still in the preliminary stages, the Teamsters have been in discussions with the Employer since they have been told that this move would impact the dock and drivers.  We will update you as soon as we receive any updates from the Employer.

On February 5, 2018 the Union filed a policy grievance against Canadian Freightways. This grievance was filed because the Employer was transferring interline updating work from the Calgary Business Centre to the TFI head office in response to our request for them to address workload issues in the department.  The Union then followed up by filing an individual grievance regarding the same issue and another policy grievance regarding regular updates being performed by non-bargaining unit members.  The latter two grievances were held in abeyance while we met at a grievance meeting in Calgary to address the initial interline updating transfer of work. The Union is arguing the exclusivity of this work under Article 6.04 of your collective agreement:

6.04   Exclusivity of Bargaining Unit Work

Only Regular Employees and/or Part-Time Employees will be hired or used by the Employer to perform work coming within the scope of this Agreement.

The Employer is arguing that this work has always been shared work and that the Union does not have exclusive rights to it.

The Union will be discussing the grievance with their Arbitration Review Committee on July 10, 2018 and will be seeking approval to forward these grievances to arbitration. We will update you on the committees’ recommendation after the review.
