CMBC – Arbitration Award: Defending your right to a joint investigation

We are pleased to let you know that we have successfully won a policy grievance that upholds your rights to have your union jointly investigate discrimination-based complaints (see Article 23.01 [e] of your collective agreement) even when the respondent is an exempt employee.

This is an important right for you because it means your union can better ensure you have a safe workplace, free from discrimination-based bullying and harassment.

The ruling was a result of a policy grievance we filed in September 2024 in response to your employer’s interpretation of Article 23.01 (e) with the award being issued by Arbitrator Ken Saunders on September 9, 2026. You can find the decision here.

Enforcement of ruling paused during bargaining

Despite winning this decision, the Arbitrator has noted we cannot enforce this right until the conclusion of the ongoing round of bargaining. They made this ruling to ensure the employer is given an opportunity to negotiate new language.

Your bargaining committee will go through this process in good faith and remains committed to bringing the best possible deal to the membership for ratification.
