ICBC – Claims Legal Services Involuntary Layoffs

To: All MoveUP Members at ICBC in Claims Legal Services
We have been advised that the Corporation has issued layoff notice to 7 members in Claims Legal Services (CLS). We have been assured by the Corporation that they have already found placements for these individuals within the Corporation, so that all of these members will have the opportunity to stay employed with the Corporation, should they so choose.
Laid off members will be provided with their options by the Corporation which include placement in a vacant position, or the acceptance of severance pay. A response is required by June 23, 2026.
Provisions of Article 8 – Layoff and Recall
Placements – Article 8.01
Article 8.01 of the collective agreement requires that any layoffs should be in order of seniority (i.e. The most junior employee in the affected job classification shall be the first laid off). It is also required that the Corporation make effort to place all laid off employees into a vacant, regular position within the employees’ skills, aptitudes, education and experience or equivalency.
Bumping – Article 8.02
If the employee has the prerequisite education and experience, or equivalent, they may elect to bump into a position of a higher pay grade than the placement position offered.
There are additional parameters for bumping outlined in the collective agreement based on years of service and it is recommended that affected members reach out to their union representative to review to ensure there is a full understanding of the language and how it applies to the individual.
Notice and Severance Pay – Article 8.03
Article 8.03 of the collective agreement includes a requirement that employees be provided with written notice of layoff and severance pay as follows:
- Employees with less than 3 years’ service will receive 2 calendar weeks’ notice
- Employees with more than 3 years’ service will receive 4 calendar weeks’ notice
Article 8.03 also outlines the amount of severance pay that employees qualify for based on their years of service:
- Employees with up to 2 years’ service will receive 3 weeks’ pay
- 2 weeks’ pay for each year of service in excess of 2 years, up to 5 years
- 3 weeks’ pay for each year of service in excess of 5 years
We recommend that all affected employees review Article 8 in its entirety as this bulletin is only a summary of the main points. Your union representative will be reaching out to you to go through your options and answer any questions you might have.
To our members who have received layoff notice, please know that we recognize the seriousness of what you are facing, and we want to acknowledge the significant impact of job loss.
We will continue to support you as the collective agreement processes are worked through and will work to ensure that all negotiated entitlements, collective agreement rights, and statutory protections are respected.
We are currently assessing whether Section 54 of the labour code applies, as well as Article 9 of the collective agreement which offers additional protections when a layoff is the result of technical or procedural changes. We will provide an update once this has been determined.
Please be aware that the Employee and Family Assistance Program (EFAP) is available to you should you require additional support and you are entitled to mental health services up to $2,500 through your extended benefits plan, until your employment with ICBC concludes.
