David Suzuki Foundation – Bargaining Update #1

To: All MoveUP members at David Suzuki Foundation
I would like to thank the members who were able to attend our Welcome to MoveUP session in person and virtually. If you were unable to attend, please find the information sheet (Here). You can also find all bulletins sent to your membership on our MoveUP website (Here).
On November 28, 2024, your union sent a bargaining disclosure request to the employer. As of now, we expect to receive the information no later than December 16, 2024. The employer notified your union that a communication, pertaining to headcount reduction, was to be sent to you on December 9, 2024. I have asked for particulars with respect to their layout plan. Below is the information about freeze after a certification is issued by the B.C. Labour Board:
The employer cannot change the terms and conditions of employment of the employees for twelve months after the union is certified or until a collective agreement is reached, whichever is earlier. During this time, changes can only be made if the union agrees, or the Board gives its permission.
An employer can lay off, discipline, or dismiss an employee during this freeze period if it has proper cause to do so. However, if the discipline or dismissal is driven in any way by anti-union feelings, then it might not matter whether the employer has proper cause. During this freeze period, the employer also has the right to make a change in its operations that is reasonably necessary for the proper conduct of its business.
