UPDATE: Common Employer Application and Expiry of Collective Agreement

The Parties are currently in the process of providing submissions on whether or not an evidentiary hearing needs to be scheduled regarding your Union’s Common Employer application. We have tentatively booked hearing dates in May 2022.
We have been receiving a lot of questions in and around the current collective agreement that is set to expire on March 31, 2022. The current collective agreement has a continuation clause, which is seen in Article 22, and the important part of the provision can be seen below:
After the expiry date and until a revised Agreement is signed, this Agreement and all its provisions shall remain in full force and effect until such revised Agreement is signed without prejudicing the position of the revised Agreement in making any matter retroactive to any date detailed in such revised Agreement.
This type of provision ensures that the Parties will continue to work under the terms and conditions of an expired collective agreement until such time as a newly negotiated collective agreement is achieved. What it does not provide for is the ability to have a general wage increase as of April 1, 2022. This needs to be negotiated, and so come April 1, 2022, there will be no wage increase.
We will continue to update the membership with information as it is made available to us, as the matter is in the hands of the BC Labour Board.
