The Reach Gallery Museum – Potential Unfair Labour Practice Complaint

MoveUP has identified a potential Unfair Labour Practice committed by your employer. This occurred when your employer decided not to pay part-time employees of the Reach for what would have been their regularly scheduled work hours between December 25 and 31, 2023.

Your employer’s practice of paying employees their regularly scheduled hours of work for the week between Christmas and New Year’s has been in place for approximately 6 years. According to the Labour Relations Code of British Columbia, an employer is obliged to maintain a ‘freeze’ on work conditions for 12 months after certification.  In contrast to this rule, some of you have reported to us that you did not receive pay for the week between Christmas and New Year’s and have identified this matter as a priority for your Union to address.

We hope to be able to address this matter cooperatively with your employer, but should it be necessary, your union is prepared to file a complaint with the BC Labour Relations Board. A formal request for payment was submitted today to your employer.
