Statutory Holiday Recovery Day Grievance

To: All MoveUP members at CMBC Customer Information & Transit Security


As you will recall, your union initiated a grievance late last year in response to the unilateral decision of the employer to require the signing of “SR Days”. The practice of requiring signing is in violation of the collective agreement, which requires the days to be scheduled in the pay period they are earned, or the following pay period, or to be banked. We heard from many of you that the new directive imposed by the employer limited flexibility, and forced you to take full weeks of SR Days off even when you had no reason or desire to do so.

We have met with the employer for the Stage 2 grievance meeting, and have had various discussions in an effort to find a mutually agreeable solution. Unfortunately, the employer denied the grievance and no solution has been found.

As a result, we began preparing the grievance to advance to arbitration. The grievance has now been approved to proceed to arbitration and we have contacted the employer regarding selection of an arbitrator and scheduling of dates for the case to be heard. We will update you further as the process unfolds. Thank you for your patience and support as we press forward with this case.
