ICBC-COVID-19 Vaccine Policy Grievance – Arbitration and Section 54 Complaint Update

February 8, 2023

To: All MoveUP members at ICBC

From the beginning of the vaccine mandate, your union recognized that this issue turns on fundamental human rights. For that reason, the union turned the matter over to one of the province’s most prominent legal firms to guide our decision making and to safeguard the rights of our members. This grievance seeks to make whole those of our members who were impacted negatively by the vaccination mandate. The arbitration hearing is completed, both parties to the dispute have concluded submissions, but we have yet to receive a decision from Arbitrator Saunders. We will continue to keep members updated once we receive the decision and examine the implications.

Likewise with the section 54 complaint, we continue to wait for a conclusion to the process. Upon its conclusion we will provide a more detailed update.

Without question, this entire pandemic has been a very stressful time for everyone, regardless of where each person lands on the issue of vaccinations and specifically this policy.  We are confident that all our members will remain committed to a workplace free of harassment and stigmatization.

In Solidarity

Kevin Smyth, Senior Union Representative
Annette Toth, Vice President of ICBC
