ICBC – Concern Regarding Shift Start Times

To: All MoveUP members at ICBC


We recently were made aware of communication from ICBC’s operational managers regarding shift start times, which was worded in a manner that gave us cause for concern. The wording as reported to us directed MoveUP members to be logged in and ready to start work at the beginning of their shift, and if their shift started at 8:30am, they were to be green and start working their queue at 8:30am.

Many of you contacted us about this communication, concerned that operational management was implying that you were to log into your work systems prior to your scheduled shift start time so that your status online was “green” as of your scheduled shift start time. We shared your concern and raised this with ICBC’s Employee Relations Department for clarity and to ensure operational management was not implying that you were to work unpaid time for logging into work systems prior your scheduled shift start time.

To date we have not received a conclusive or clear answer from ICBC.

To be clear, the union’s position is that logging in to the ICBC systems on the ICBC equipment is ICBC work, and as such it is what you are paid to do. For many of you, unless you work reduced or part-time hours, working before your regular start time, will attract overtime wages.

Please be aware that ICBC and MoveUP share an arbitration award (attached) regarding hours of work and unpaid overtime. ICBC lost that arbitration. As a result of that loss, ICBC was required to compensate members who worked prior to or following their scheduled hours of work. This remains the requirement today. Depending on your hours, if you are required to log in to systems prior to your scheduled shift start time, you would be owed overtime, and must submit the request for payment.
