Enterprise Membership Update – Re: Bargaining Unit Work and Recall

To: All MoveUP members at Enterprise
Your union has been advocating to have members recalled as soon as possible.
We have heard from members that managers have been performing bargaining unit work. In our discussions with senior management, they have made it clear that they do not want managers doing work that according to the collective bargaining agreement (CBA) should be done only by MoveUP members.
The CBA contains the following clause:
ARTICLE 6: SECURITY OF BARGAINING UNIT WORK
6.01 Exclusivity Of Bargaining Unit Work
Duties normally performed by employees within the bargaining unit will not be assigned to or be performed by non-bargaining unit employees except to overcome immediate, short term cases of absenteeism, emergencies, training and peak rental periods when bargaining unit employees capable of performing the work are not available.
We are asking all members who are working to assist us with policing the CBA. There are several ways that this can be done. The most effective method is to simply ask managers to not do bargaining unit work when you observe them doing it. There is nothing wrong with respectfully requesting that a manager stop doing our work. This is a reasonable request, and we will of course strongly respond to any repercussions that might flow from such a request.
A few years ago, a form was developed to assist with reporting when bargaining unit work is being done by someone who is not in the bargaining unit. That form can be found here. Please take the time to fill out the form if you see a potential violation of the CBA.
Managers doing bargaining unit work is unacceptable at any time but particularly so when we have so many members laid off. It is a clear violation of the CBA. We want our members to be recalled to perform our work. We know it is getting busier and we want to see more recalls and we want them to happen as soon as possible.
