Complaints under Article 16 of our Constitution have been filed against three members of the bargaining unit for allegedly crossing the BCGEU picket line during the current dispute. The Executive Board considered the three complaints today, along with the submission from the one member who filed a response. The Board found that there is a prima facie case to proceed and has accordingly struck a Trial Committee under Article 16.3 to hear the case. The Trial Committee will convene hearings in Penticton as quickly as practical. The Trial will hear from the complainant and any witnesses they call, and the respondent and any witnesses they call. They will then render a decision, and any penalty assessed, if appropriate.
We will advise further as soon as the hearings are set.
