Canadian Freightways Bulletin Re: Bargaining Update & Outstanding Issues

BARGAINING:

We have provided your Employer with notice to bargain and proposals have been drafted and are ready to be presented at the table.   Thank you for providing your suggestions for an updated collective agreement, either via our online survey or in person during my site visits in October.  We expect that the Employer will defer dates until early next year as they have advised us their time in the next month or two is limited.

RESTRUCTURING APPLICATION:

The process for the restructuring application filed by the Employer to transfer MoveUP members into the Teamsters certification is now complete and before the Canadian Industrial Relations Board. There are 3 members for each decision-making panel, most of whom are located in Ottawa.  The panel will have to find time to decide on the case, so it may take a long time to receive a response.

They will either determine whether a hearing is required or if a decision will be rendered. If they require a hearing, we should hear something in the next few months.  If we are not contacted in the next few months that may indicate that they will decide without a hearing and we will get a decision within a shorter time frame.

We are being told that the average duration from application to decision is 196 days; 80% of cases are decided within a year; and the decision making/writing process takes an average of 80 days. Unless it is set down for a hearing, we should have a decision by February or March.

INTERLINE ARBITRATION:

Dates are scheduled, and the parties will be meeting for the exclusivity of bargaining unit work arbitration April 3-5 in Calgary.   The Union had filed a policy grievance on interline updates being taken away from MoveUP members and performed entirely by Transforce employees.  Other bargaining unit exclusivity grievances are being held in abeyance pending the result of the interline grievance.

FED EX DEDICATED WAREHOUSE:

The Employer is moving forward and dividing the Burnaby terminal into two separate entities, one being a dedicated Fed Ex side, the other providing support to the rest of Canadian Freightways customers. The Union maintains our position that any clerical work performed on the Fed Ex dedicated side should be performed by MoveUP members.  We have discussed this with the Employer extensively, however, if they decide not to abide by the collective agreement and bring in non-union employees, the Union will take whatever steps are necessary to retain our bargaining unit work.
