BCH & Powertech – WorkSafe BC Stay-at-Work/Return-to-Work

The union has been made aware of the employer’s implementation of a WorkSafe BC Stay-at-work/return-to-work package. It is important to note that these documents refer strictly to injuries that occur at work and are covered under WorkSafe BC. For injuries that occur outside of work the process of how the employer can obtain medical information is outlined in the collective agreement under Article 15.07. The union reviewed the forms and determined that it is not reasonable for employees to “report the injury or illness to their manager immediately” as it might not be practical in some situations. As such, the employer agreed to change the language to “as soon as practicable after the worker is injured” as per Worker’s Compensation Act Section 154.2(2)(a).
Furthermore, the employer agreed to involve the union in discussions regarding modified duties to align with the Collective Agreement MOU#36. MOU#36 pertains to the employer’s duty to accommodate when faced with a medical condition restricting an employee’s ability to perform their regular work duties.
