ICBC: Tentative Agreement Amendment – IMPORTANT UPDATE

On Monday, May 25, 2020, MoveUP and ICBC reached a tentative collective agreement. As can often happen in bargaining, misunderstandings at the 11th hour can occur. After sending out the tentative package, both ICBC and your bargaining committee heard from the Customer Recovery Specialists regarding a change from the Nine-Day Fortnight (9DFN) to a Flexible Work Week with a 5% pay premium. From our perspective, we believed that the employer had wanted this change and needed to move that job specifically to a flexible work week.

Late afternoon yesterday, ICBC’s bargaining committee called to let us know that in fact they had not meant to do that and wanted this job on the 9DFN all along. They apologized for the misunderstanding and wanted to see if we could agree to fix this.

Since Tuesday, we have heard from many Customer Recovery Specialists who also told us that they wanted to keep the 9DFN and did not want to switch to TO days with flexible hours and the 5% premium. We appreciate the feedback from these folks as it helped us with this very delicate problem.

We also noticed that both our bargaining committee and ICBC’s bargaining committee had forgotten to include a minor amendment to the language around lateral transfers. When we raised this with them after the Memorandum of Settlement had been signed, ICBC was unwilling to make any change. Today, with both parties having items that needed to be cleaned up and clarified, we have agreed to the following amendments to the tentative agreement:

  1. Customer Recovery Specialists will remain on the 9DFN and will fall under the provisions of LOU 28 – Provincial Scheduling.
  2. Lateral transfers will be amended so that people who want to apply to a different job/position in the same pay band can do so after 12 months, instead of having to wait 18 months. Moves within the same job/position, will remain at 18 months.

Both bargaining committees have committed that there will not be any other amendments to this MOA. Should there be any other concerns, they will be appropriately addressed down the road and after this package is ratified or rejected by the members. The amendments are attached here. These items will be included with the full package that you will vote on starting on June 3, 2020, at 8:00 a.m. We will walk everyone through the entire package during the Telephone Town Hall on the evening of June 2, 2020, from 6:30-8:00 p.m. We hope you will make time to join the TTH on June 2nd.

We apologize to the Customer Recovery Specialists for all the stress and concern that this misunderstanding may have caused. We hope this resolves your concerns over changing your 9DFN. Your bargaining committee is still recommending ratification of the entire tentative agreement, including these amendments.
