ICBC – Enhanced Care, Reduced Rights? ICBC Tries to Dodge Article 9 Protections

We are continuing the fight for our members in the Claims Legal Services department to ensure ICBC provides them with all the bargaining protections and entitlements they are entitled to.

As you know, in May 2021, ICBC switched from a tort claims model to Enhanced Care. Over the past five years, work in the Claims Legal Services department has wound down as the remaining tort claims are closed.

ICBC disagrees that Article 9 applies for these members and has dismissed our policy grievance (the denial can be read here).

 About Article 9 – Technological And Procedural Change

Article 9 of your collective agreement contains specific protections for you when these changes happen at ICBC. The process for when work is made redundant due to technological and procedural change and the options that affected employees are then entitled to are outlined in this article, including, placement and bumping options, as well as severance and enhanced salary protection, should they elect to stay with ICBC.

These entitlements are not optional or discretionary – they were fought for and agreed to by ICBC. Now ICBC needs to uphold the agreement they made.

Our view is clear. The displacement of our members due to the switch to Enhanced Care is a direct result of new claims procedures. This is not a mere reorganization or reassignment of duties – the whole claims model changed, creating new processes, new job titles, and a substantial change in the way the work was performed and the product that is now offered. The change in the claims model fundamentally altered the system and procedures utilized.

Next steps

Despite ICBC denying our grievance, this fight is not over. We are committed to pushing our policy grievance forward until such time that ICBC is held accountable.

We need to show ICBC that they cannot make significant changes to the way work is done and not provide you with the protections and entitlements you bargained for.
