Picket Line Frequently Asked Questions

MoveUP has learned that there may be a labour dispute between at Avis-Budget.

We want you to be aware of potential job action, and in case you do encounter a picket line outside your workplace, here is what you need to know.

Frequently Asked Questions

1. What Do I Do if I See a Picket?

That answer is simple: DO NOT CROSS.

MoveUP members at many worksites have the right to not cross a legal picket line without fear of discipline. At Enterprise and Hertz/Dollar Thrifty, your agreement has collective agreement provisions as follows:

Enterprise

11.02 Crossing Picket Lines

(a) It shall be no violation of this Agreement for any employee to refuse to cross a picket line recognized by the Union. Any employee thus failing to report for duty shall be considered to be on leave of absence without pay and shall not be subject to any disciplinary action, discharge, termination or any other penalty or prejudice.

(b) Should the Union be advised or learn of a picket line or potential picket line at or around the Employer’s workplace(s), the Union will advise the Employer of same and discuss the potential impact of the picketing and ways to reduce said impact.

Hertz/Dollar Thrifty

10.02

It shall not be a violation of this Agreement or cause for discharge or discipline of any employee, in the performance of the employee’s duties, to refuse to cross a legal picket line recognized by the Union, and the Employer will not ask employees to cross such a picket line. The Union shall notify the Employer as soon as possible of the existence of such recognized picket lines.

A picket line can only be ruled illegal by a Labour Relations Board ruling or by the courts.

2. I Have Questions—Who Should I Contact?

a) Job Steward at Your Worksite
Contact your job steward who may have the latest up-to-date information.

Labour disputes, when they occur, can be fluid, and there are often frequent updates and developments.

3. How Do I Tell If It’s a Picket Line?

If the people are wearing picket signs “On Strike,” it’s a picket line.

4. Will I Lose Pay or Benefits?

The union will ensure you will receive picket pay if you are scheduled to work at a rate of $144/day.
