ICBC-COVID-19 Vaccine Policy – Arbitration and Section 54 Complaint Update

To: All MoveUP members at ICBC
We are writing to provide an update on the grievance and our Section 54 complaint related to ICBC’s COVID-19 vaccine policy.
A negative feature of the ICBC vaccine policy is that employees who fail to comply with obligatory vaccination are put on an unpaid leave of absence. In reply our position is that the corporation should have given your union better notice and an opportunity to negotiate better terms. For example, we take the view that where practical, non-compliant members should be let work from home, in physical isolation from co-workers, as an alternative to an unpaid leave of absence.
Re: The Section 54 of the Labour Code complaint
We are still waiting for a decision from the Labour Board. For any of you who pay attention to these matters you will know this has been a longer than normal wait. Unfortunately, the delay is not a matter that your union has direct control over.
Even though this information does not represent a new development in the case, we felt we should provide an update due to the passage of time.
Re: The grievance arbitration
The arbitration is set to commence by written submissions in mid-July. We will provide further updates when we have them. Arbitrations can conclude rapidly or last several months before an award is published by the arbitrator. At this juncture is not possible to predict how this case will play out.
As we have throughout the pandemic, we recognize that the decision to get vaccinated is a personal one, but we do encourage all our members to get the COVID vaccinations.
