BCH & Powertech – Update on adjustment plan for partially vaccinated or unvaccinated members

To: All MoveUP members at BCH & Powertech
We have now finalized our agreement with your employer regarding the Section 54 adjustment plan for those members who were affected by the employer’s vaccine requirement.
As we informed you back in January, under this agreement, if you were partially vaccinated (i.e. one dose) as of January 10, 2022, you would not be placed on unpaid leave and you would be permitted to continue work if you provided evidence of an appointment to receive a second dose of an approved COVID-19 vaccine (or agreed to provide evidence if you had not yet received your invitation), and you attended your appointment to receive your second dose.
If you were unable to attend your appointment for a second dose, you had to immediately book and attend an alternate appointment to receive your second dose. You had to provide evidence of an alternate appointment.
Moving forward, as part of the terms of the adjustment plan, we have agreed to defer the hearing of our policy grievance until after April 7, 2022. We have additional arbitration dates pursuant to Section 104 (4) of the Labour Relations Code on May 12, 13, 18-20, 2022.
Until the policy grievance has been settled, no members will be terminated for being unvaccinated until a decision is issued by the arbitrator in relation to the IBEW policy grievance. This does not apply to members who have misrepresented their vaccination status (i.e. indicated they had received an approved COVID-19 vaccine when they had not).
If you have been placed on unpaid leave as a result of the policy, you may access your personal time banks and ask for it to be paid out for any period you have been on, or remain on, unpaid leave.
