ICBC – Holiday Pay Arbitration Win

To: All MoveUP members at ICBC
Last year, we were advised by one of our ICBC members that your employer was not paying them their duly owed holiday pay in accordance with Article 16 of the Collective Agreement while they were on a gradual return to work plan (GRTW). A grievance was filed, and after attempts to have ICBC see the error of their ways, we proceeded to arbitration on November 25 and 26, 2020.
We felt we had a strong argument and the arbitrator agreed with our position. This decision confirms that regular employees who are participating in a GRTW program should be paid their holiday pay as is outlined in our collective agreement. The decision further confirmed that regardless of the number of hours a regular employee was working on the GRTW, they would still be eligible for the full day of pay for the holiday.
