CMBC – Spread Over Premium Policy Grievance

We hope this message finds you well. On behalf of your Bargaining Committee, we hope that everyone in the membership is doing their best considering the unprecedented time we are currently in with the COVID pandemic. Your Bargaining Committee sincerely appreciates all the hard work and dedication all our members have shown over the last several months to continue to provide transit services to the general public.

The employer has written to the union and informed your Union Representative, Parm Sandhar, of their intent to implement split shifts in the depots this coming fall. Your Bargaining Committee unequivocally disagrees with the employer’s position and their assertion in the application of the new language in Article 11.04. As such, the union has filed a policy grievance effective today with the employer. Please see the policy grievance letter attached here.

Your union will do everything it can to assert our rights and argue our position on this matter, up to and including pursuing this matter to arbitration if the employer does not acquiesce on their position. Please understand that we must follow the “work now grieve later” labour relations doctrine, whereby members cannot refuse to work a split shift. If you are required to work a split shift by the employer, refusing to do so could subject you to potential discipline for insubordination. Your entire Bargaining Committee is not taking this matter lightly, as it is a serious threat to our union rights, however, the arbitration process can be lengthy in nature.
