New Union Members for Yellow Pages and Employer Statements About Their Pending Certification

The Union has received an email communication from Yellow Pages CEO, Sherilyn King she sent to employees regarding a pending certification for some employees who wished to be part of the Union.
The communication by the employer is concerning because the BC Labour Relations Board has yet to rule on whether the new employees will be placed in the current agreement with the Sales staff or within a new bargaining unit with a separate collective agreement.
You should be aware that the Labour Relations Board often grants certifications for new employees within an existing collective agreement and an existing certification even when employees have different roles and responsibilities.
The employer’s communication appears to be attempting to argue legal positions with its employees and making assertions about what the Union’s positions are.
At no time has the Union ever said that collective agreement provisions for existing MoveUP employees would be affected by the inclusion of new members into the collective agreement.
New provisions for the new employees will have to be discussed especially in areas where existing provisions may not be applicable.
Having the Union and the Employer do this work does not mean, in any way, that it requires that new employees can only be served by a distinct collective agreement.
Furthermore, it is inappropriate for the Employer to request that union members reach out to the Employer to receive “clear and factual information” especially when the Union’s positions have been mischaracterized.
