Know Your Rights: Medical Privacy

The law recognizes that your medical information is highly personal and therefore deserves the greatest protection.

When you call in sick, your manager might require you to contact them at a specific phone number rather than email or texting. However, they are not allowed to pry for details, as this is often sensitive and personal medical information. Your manager is entitled to know that you are taking a sick day, you are unable to work and the date of your expected return to work.

The information your employer can seek is limited. If the employer requires more information than described above due to a more lengthy absence, they should provide you with a form to present to your physician. These forms, when properly completed, should provide your employer (via Manulife) with all the information it needs to properly administer its sick leave plan, while also protecting your right to privacy.

It is only rarely that you may be required to provide further information to substantiate an absence due to illness or injury. In those cases, you have the right to know why more information is being sought. Questions about your diagnosis, medications and treatments, medical history and subjective symptoms are generally inappropriate.

You have the right to privacy. If you are being asked for additional information by your employer or Manulife, and are unsure whether you need to provide it, contact your union office.
