Do Not Work Unpaid Overtime
March 14, 2019
To: All MoveUP members ICBC Claims Contact Centre
MoveUP wants you to understand that the new requirements for the desk sharing and recycling are considered work.
The new procedures take time and must be considered as work time. Arriving at work under the desk share program, means your work responsibilities include finding your desk, proceeding to your locker to get your personal items, ergo equipment, headset and other personal tools. Once you locate your desk, you need to set the desk height for yourself and the chair for your ergonomic needs. Once all of that is settled, you prepare your computer to commence the day and place yourself on ready for the calls.
This is all considered part of your work day. MoveUP wants to remind all of you that if you are starting before your start time to get your desks ready, this is considered unpaid overtime. We won an award in 2012 on this, and the employer must pay you. They may inform that they will discipline, and they have the right to do that, however, MoveUP can grieve, if discipline is meted out. The fact that the Corporation knowingly allows you to work unpaid overtime, but then would possibly consider discipline under its overtime policy is a clear indication that they really do not care about you the employees/our members.
This also applies to the new procedures at the end of your shift. You have new responsibilities such as clearing your waste basket, sorting your recycling, disinfecting your desk, and putting your supplies back into your locker. All of this is work that must be paid for by the Corporation. Give yourself time at the end of the shift to comply with these obligations. We encourage you to refrain from working unpaid overtime or report it to your stewards if you do end up staying over your shift.
I have asked the Job Stewards to ensure that all of you who have started early and stayed late and continue to do so, submit your time to your supervisor. I have also indicated to all the stewards that if you are unwilling to submit your time, they do so for you. Please submit your time and/or let your Job Stewards know the dates and times you have worked unpaid. We need your information to grieve this violation of the collective agreement.
Every time you work 1 second over your shift, you are entitled to one half-hour of overtime. The Corporation has every intention to phase in desk-sharing to its other call centres; together, we can change operations at work to benefit all of you as members.
In solidarity,
Kelly Quinn
