Coast Mountain Bus – Job Selection Policy Grievance 19-0102

To: All MoveUP members at Coast Mountain Bus
The Union recently filed a policy grievance challenging Coast Mountain Bus Company’s (“CMBC”) application of article 7.11 (d) of the collective agreement:
- Job selection and promotions under the foregoing shall be on the basis of ability (to perform the vacant job) and seniority, in that order. Where the employee who is junior, his/her ability to perform the vacant job shall be significantly and demonstrably higher than candidates who have greater seniority.
A review of labour relations case jurisprudence suggests that a junior applicant needs to beat a senior applicant anywhere from a 10-15% score differential, CMBC has unilaterally instituted a scoring differential of less than 15% and has been using a 5% differential on numerous job postings. The Union has a fundamental difference of opinion with CMBC on this application, hence a policy grievance was initiated.
If you see any posting with a less than 15% scoring differential posted for the MoveUP bargaining unit please notify a steward so that the Union can initiate a grievance to attach to the policy grievance. Please feel free to contact me if you have any further questions.
