FAQ: Proposed Change to the Application of Sign-up Seniority Rights in Transit Security
Q: Was there a petition circulated in Transit Security?
A: Yes, a petition was circulated in Transit Security containing 37 signatures. The petitioners are requesting a change to the application of seniority rights during shift sign-up
Q: How does Seniority currently work during sign-up?
A: Seniority is governed by Article 6 of the collective agreement.
Article 6.01 says:
All employees of the Employer as of November, 1985 shall have their accumulated seniority as total continuous elapsed time as an employee of the Employer and its predecessors in a job category under MoveUP jurisdiction.
Article 6.02(a) says:
No credit shall be given for terms of temporary work except as provided in (a) and (b) below:
(a) Full-time temporary and casual employees who obtain regular status, shall be granted seniority calculated from their Employer entered service date within the MoveUP jurisdiction based on all hours worked (excluding overtime) since March 26, 2005.
This means that all members are credited for all time served under MoveUP’s jurisdiction since 6 November 1985.
Casual employees receive credit for all hours worked since March 28, 2005, under MoveUP’s jurisdiction upon becoming a regular (FTR/PTR) employee.
Q: What are the proposed changes on the petition?
A: The petitioners wish to see “the length of continuous service during which the employee has been a regular employee within the group classification of shift workers that have elected to have a sign-up” be the determining factor for seniority at shift sign-up.
Q: What will change at sign-up if this happens?
A: This means that the deciding factor at shift sign-up will be “length of continuous service within a group classification”.
Members will no longer be credited for all hours worked in other job categories or “group classifications” under MoveUP’s jurisdiction.
For example, a TSO with 25 years of service in the “group classification” of TSO will start from the bottom of the seniority list if they a promoted to SOC.
Q: Will I still receive credit for all hours as a casual at sign-up?
A: No. MoveUP’s understanding is that the petitioners seek to have the date of entry as a “regular employee” be the determining factor at sign-up, meaning casual hours under MoveUP’s jurisdiction will no longer be considered during shift sign-up.
Q: Will there be changes to the current seniority list if this change is implemented?
A: Yes. Hours worked as a casual will no longer be considered for shift sign-up purposes. The determining factor will be date of entry as a regular employee under MoveUP’s jurisdiction. Employee numbers will be the tiebreaker for members who entered service as a regular employee on the same date after March 31, 2019, according to Article 6.09:
For employees hired after March 31, 2019, if two (2) or more employees have the same seniority date, their relative seniority shall be determined by their Employee Number, as issued by the Employer on their date of hire.
Q: Will this change affect my seniority when it comes to layoff/recall and vacation entitlements?
A: No. MoveUP’s understanding is that the petitioners seek to change the application of seniority during shift sign-up only.
Q: Is there anything else I should know?
A: Yes. Some members will gain from this, and others will lose out on seniority rights they previously had at sign-up. We anticipate that there will be significant changes to the seniority list at sign-up if this change is implemented.
Q: As a member working in the Transit Security department, do I have a say in the matter?
A: Yes. You will be asked to cast an anonymous vote starting Thursday, March 12, 2026. The vote will close at 4pm on Thursday, March 19, 2026. Members will receive a link to a survey from an application called Survey Monkey.
Q: If the majority vote in favour, is the proposed change guaranteed to happen?
A: No. There needs to be a clear majority in favour of this change. Even if the majority are in favour, the bargaining committee will need to draft a proposal. Like every other bargaining proposal, this proposal will need to go through MoveUP’s approval process. MoveUP’s principals will need to carefully consider the effects of this change on the members in the Transit Security department, and in every other department at CMBC prior to approving.
