ICBC – Changes to When You Need to Provide a Sick Note

On November 12, 2025, under BC’s Bill 11 (Employment Standards Amendment Act, 2025), employers in British Columbia are prohibited from requesting medical notes for an employee’s first two health-related absences (sick days) of up to five consecutive days within the same calendar year.
How does this impact ICBC and our Collective Agreement?
In British Columbia, if legislation provides greater rights or expands protections beyond what is outlined in a Collective Agreement, the legislation takes precedence.
Our Collective Agreement currently states under Article 17.12(a) that the employer may request medical documentation after three consecutive sick days. That specific language is no longer relevant with the introduction of Bill 11.
The remainder of Article 17.12 remains in effect: Under Article 17.12(b), the employer may request medical documentation for any sick-related absence exceeding three days beginning with the third occurrence in the same year.
- Under Article 17.12(c), any required medical documentation costs must be covered by the employer. Members should keep receipts and submit them to Wellness for reimbursement.
- Under Article 17.12(d) and (e), the employer may request medical documentation at any time when there is a serious illness, prolonged injury, or suspected improper use of sick leave.
Other Important Reminders:
Managers must not request or handle medical documentation. Only ICBC’s Disability Management Specialists are authorized to request and manage this information. If a manager requests medical documentation, please contact a Job Steward to report it.
Your medical information is private and sensitive. If you are unsure what to share, contact your local Job Steward or Union Representative.

You can reach the ICBC Disability Management team at HREmployeeWellness-1@ex.icbc.com (only using your internal ICBC email). They will assign you a Disability Management Specialist to work with you directly. We also recommend keeping your Union Representative copied on these emails for support.
