Avis – Common Employer Application and Recall Period Update

February 26, 2021

To: All MoveUP members at Avis

Your union would like to update you on a couple of important items.

Late yesterday your union received a decision from the Labour Relations Board (LRB) confirming that MoveUP is the collective bargaining agent for both the Avis and Budget brands and the collective bargaining agreements in place.  The decision specifically establishes that the Teamsters no longer have a role to play in the process.  The full text of the decision can be found here:

We will be discussing the next steps in the integration process with the employer and moving forward accordingly.  As many of you were aware, the process was unable to move forward while there were three parties involved.

While the submissions were being made to the LRB, your union was working to address the issue of our new members from Budget only having a six month recall period rather than the twenty-four month recall period enjoyed by our members who work at Avis.  Securing the longer recall period was critical as our new members on layoff have all surpassed the six-month period and would have been subject to immediate layoff.  We are pleased to announce that your union has been able to secure the twenty-four month recall period for all members who have worked for Budget for longer than twenty-four months.  This means that all eligible members will have twenty-four months to be recalled from the date when they were laid off.

We have been asked about the new combined (dovetailed) seniority list.  While the list is close to being finalized it is not yet complete.  To ensure that only the finalized seniority list is being used we will not be providing a draft of the list.  Once the list is finalized, we will provide it and ask that all members review it to ensure that any errors are immediately addressed.  We have tentatively agreed that the new list will be employed as members are recalled to work.

Your union has been asked by several people about the possible timing of members being recalled.  Unfortunately, at this point there is no way to accurately predict when members will be recalled.  Like everyone else, your union is hopeful that the vaccine rollout will happen as soon as possible and that this will allow the lifting of travel restrictions and a return to normal in the car rental industry.  As we see rental numbers increasing, we will advocate for members to be recalled as soon as possible.

If you have any questions about the above or anything else, please contact Union Representative Shawn Lakusta at slakusta@moveuptogether.ca.

In Solidarity,

Shawn Lakusta, Union Representative
Christy Slusarenko, Vice-President of Combined Units
