Seaspan ULC – Queen’s Day of Mourning Grievance

February 27, 2023

To: MoveUP Members at Seaspan ULC

As you are aware, your union filed a policy grievance related to September 19, 2022, the Queen’s Day of Mourning. After much consideration, your union has made the decision to not proceed to arbitration.

We did so due to recent arbitral jurisprudence which supports the argument your employer made to distinguish between a day declared a holiday by the government for its citizens in its capacity as a governing body, and a day declared a holiday by the government for its own employees in its capacity as an employer.

A recent arbitral decision upholds the view that the federal and provincial governments did not make the holiday sufficiently broad or official to trigger the language in your collective agreement that would include it in the list of holidays your employer is obliged to honour.

If you have any further questions, please contact your job steward, Dale Gibson, or email ygarie@moveuptogether.ca

In solidarity,

Yudon Garie
Union Representative
