If you are aware of a violation of your collective agreement, it is very important that you bring it to the attention of your shop steward or union representative right away.

If necessary, they might need to file a grievance on your issue, to initiate the process to resolve the issue with your employer. But within each collective agreement, there is a time limit for when most grievances can be filed.

Your collective agreement

A grievance must be filed:

  • Avis: Within 10 working days from the date the complaint was discussed under the complaint procedure.
  • Dollar Thrifty: Within 14 calendar days of the occurrence giving rise to the grievance being known.
  • Hertz: Within 15 calendar days of the occurrence giving rise to the grievance being known.
  • National: Within 10 working days from the date the complaint was discussed under the complaint procedure.

Why timely action is important

If a filing timeline is missed, an Arbitrator at the Labour Relations Board could dismiss the grievance on that basis alone.

There are sometimes exceptions to the time limits listed at left for specific types of grievances. If you have any uncertainty, talk to your job steward or union representative.
